- Acceptance of Terms and Conditions
1.1. These terms and conditions ("Terms and Conditions") constitute the legal agreement between You and Interauto Grup S.R.L. - a company registered in the Republic of Moldova, tax code: 1008600032318, hereinafter referred to as – Interauto.
Please read these Terms and Conditions for any use of the website accessible at URL: www.interauto.md ("Website"). Accessing and visiting the Website, registering an account on the Website and/or using the Website services for the purpose of purchasing or renting vehicles, goods or services related to vehicles ("Services") means full and unconditional acceptance of these Terms and Conditions.
1.2. Interauto reserves the right to modify or update the Terms and Conditions unilaterally at any time. You can access the Terms and Conditions at any time at: /termeni-si-conditii-de-utilizare
1.3. If you continue to access the Website, it means you have expressed your legal agreement regarding the modification of the Terms and Conditions. If you do not agree with the proposed changes, the only option you have is to no longer access, visit or use the Website in any way.
- Terms
The terms used hereinafter shall have the following meaning:
User – any natural person, at least 18 years old, with full legal capacity, who accesses the Website, being interested in the data, information, Listings and/or Services of Interauto, as well as any natural person (including authorized natural person) and/or legal entity that purchases the Services provided through the Website.
Provider or Interauto - The company "Interauto Grup" S.R.L., a Moldovan legal entity, headquartered in Chisinau, str. Avicenna 12/1, registered with the Public Services Agency of the Republic of Moldova with state identification number: 1008600032318.
Listing – the public offer launched by Interauto through the Website, regarding the sale and/or rental of a Product.
Product - a vehicle, good or service related to vehicles that can be marketed according to the law and does not violate the limits imposed by these Terms and Conditions.
Interauto Page – the website www.interauto.md, including any section or sub-page thereof.
Operators – persons specially trained by the Provider to verify/moderate the content of Listings published by Users on the Website.
By agreeing to these Terms and Conditions, you declare and guarantee that you are 18 years old and have full legal capacity or, in the case of a legal entity, you are a registered company operating in accordance with the laws of the Republic of Moldova, and your representatives are validly authorized to express your legal agreement regarding the access, visit or use, in any other way, of the Website/Application and/or Services.
- Purpose of Terms and Conditions
3.1. The purpose of these Terms and Conditions is to define and regulate the conditions of use of the Website and Services.
3.2. The entire content of the Website, including but not limited to texts, images, graphics, computer programs, as well as any other data and applications, are the property of Interauto and/or its partners, being protected under Law no. 139/02.07.2010 on copyright and related rights with subsequent amendments, as well as all other laws, including but not limited to applicable laws regarding intellectual and industrial property rights. The retrieval of any information and/or data from the Website, for the purpose of republishing, total or partial distribution or for any other purposes, in any form, without the prior written consent of the Provider, is strictly prohibited and punishable according to the laws in force.
- Rights and Obligations of the Provider
4.1. The Provider undertakes to remedy as soon as possible any reported malfunctions related to the functioning of the Website or any discrepancies between the data provided in the Listing by the User and the data published on the Website by the Provider, except for those discrepancies due to the fact that the Provider's Operators have partially modified the Listing so that it meets the conditions imposed by this document, in order to be maintained on the Website/Application.
4.2. The Provider does not guarantee Users that the Website will be available uninterrupted, on time, secure or error-free. The Provider shall not be liable for the non-display of Listings or the interruption of their display due to causes beyond its control in any way, nor for direct and/or indirect damages that the User may suffer as a result.
4.3. The Provider is not responsible for delays caused by technical malfunctions at the level of its collaborators and/or partners.
4.4. The Provider reserves the right to delete or partially modify a Listing if it is found to violate the Terms and Conditions in any way, especially if it has content considered offensive or slanderous, constitutes unfair competition, infringes the intellectual property rights of a third party or is contrary to good practices that act to the detriment of the Provider, or violates any legal provision in any other way. The Provider also reserves the right to suspend, modify, add or delete, at any time, other portions of the Website content.
4.5. The Provider declares that it is the holder of all intellectual property rights related to the Website.
4.6. According to the legislation in force, the Provider has the obligation to immediately inform the competent public authorities about apparently illegal activities carried out by the recipients of its services or about apparently illegal information provided by Website Users.
4.7. Interauto may carry out tests and statistical analyses for the purpose of optimizing and streamlining the policies practiced and for the purpose of improving, in an objective and non-discriminatory manner, the activity of Interauto and the experience of Users, without Interauto having the obligation to inform Users about the performance of tests or their results.
- Rights and Obligations of the User
5.1. The User has the right to fully benefit from the Services, as long as no violation of the Terms and Conditions is found.
5.2. The User is strictly prohibited from retrieving any information from the Website for the purpose of total or partial republishing, in any form, without the prior written consent of the Provider.
- Complaint Resolution
6.1. Any User may file a complaint or notice concerning or related to the services offered by the Provider, respectively the Listings transmitted/published/unpublished by Interauto on the Website, within a maximum of 7 days from the date of the event and/or the appearance of the reported case.
6.2. Complaints shall be filed through the contact form on the Website.
6.3. Complaints and/or notices sent to the Provider shall include the User's identification data, the identification number of the Listing that is the subject of the complaint (if the complaint concerns a specific Listing), as well as any other data necessary for the Provider to identify the reported event and/or the claimed Listing (as applicable) and a detailed description of the reason for which the complaint/notice was filed, so that the Provider can resolve it as soon as possible.
6.4. Complaints/notices will be analyzed and will receive a response within a maximum of 30 business days from their receipt by the Provider, provided they were accompanied by a complete set of data necessary to identify the User, Listing and/or the problem.
- Agreement on Processing and Collection of Personal Data
Interauto processes the personal data of its Users in accordance with the Privacy Policy.
- Modifications to the Website/Application Terms and Conditions
The Provider reserves the right to modify the Terms and Conditions. You can access the Terms and Conditions at any time at: /termeni-si-conditii-de-utilizare. If you do not agree with the proposed changes, the only option you have is to no longer access, visit or use the Website in any way.
- Applicable Law. Disputes
9.1. The rights and obligations of the parties, mentioned in these Terms and Conditions, as well as all legal effects produced by this document, are governed by the legislation of the Republic of Moldova in force.
9.2. Any dispute related to these Terms and Conditions shall be resolved by the competent courts of the Republic of Moldova.
